These Terms apply to all contracts and uses of the "Thymetown" platform between Himmelbauer Digital Innovations e.U. (the "Provider") and users resident in Austria or the EU. Consumers within the meaning of these Terms are natural persons using the platform for private, non-commercial purposes (§ 1 para. 1 no. 2 KSchG, the Austrian Consumer Protection Act).
Thymetown is an AI-powered recipe platform. The Provider offers:
Using Thymetown requires an account (email address and password). A paid contract only comes into existence once payment is completed via Stripe: by clicking the "Subscribe" button, the user makes a binding offer, which is accepted upon payment confirmation from Stripe. Confirmation is sent by email via Stripe.
A free, 3-day trial period begins automatically upon registration — no credit card required. Full functionality of Thymetown is available during this time. After the three days expire, access ends automatically, and no payment is automatically charged. To keep using Thymetown, the user must actively start a paid subscription via the account settings (see Section 5).
The subscription costs €4.99 per month (final price). The Provider qualifies as a small business under § 6 para. 1 no. 27 of the Austrian VAT Act (UStG); the price shown therefore does not include VAT. Payment is processed via Stripe; accepted payment methods include credit and debit cards as well as other methods offered by Stripe. The first month becomes due immediately upon subscribing. The Provider reserves the right to change prices with reasonable advance notice (30 days by email for active subscribers).
The subscription is billed monthly and renews automatically unless cancelled in time. Cancellation is possible at any time without giving a reason and takes effect at the end of the current billing period; access remains fully available until then. Cancellation can be done independently via the Stripe customer portal (accessible via Account → Manage subscription) or by email to support@thymetown.com. Amounts already paid for a billing period are not refunded.
Consumers, under the Austrian Distance and Off-Premises Contracts Act (FAGG), have a 14-day right of withdrawal from the date the contract is concluded, for the initial subscription. Withdrawal can be declared informally by email to support@thymetown.com. If withdrawal is effective, any amount already paid will be refunded in full.
The Provider strives for high availability of the platform but cannot guarantee it. Planned maintenance will be communicated in advance where possible. Because recipe content is generated by AI, the Provider cannot guarantee its accuracy, completeness, or suitability for particular dietary needs (e.g. allergies, intolerances). Users are responsible for critically reviewing generated recipes before preparing them.
AI-generated recipes are not protected by copyright and may be used freely by the user. The user's own notes and meal plans in the cookbook remain the user's property. The software, layout, graphics, and other content of the website itself are protected by copyright.
Liability is governed by Austrian law. The Provider is liable without limitation for intent and gross negligence, as well as for damages resulting from injury to life, body, or health. For slight negligence, the Provider is liable only for breach of material contractual obligations, limited to foreseeable, typical damage. Liability for indirect damages or lost profit is excluded in cases of slight negligence.
The European Commission provides a platform for online dispute resolution (ODR): ec.europa.eu/consumers/odr. The Provider is not obligated, and is not willing, to participate in dispute resolution proceedings before a consumer arbitration board, but will make efforts to find a direct, amicable solution.
Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). For consumers resident in Austria, the consumer's general place of jurisdiction applies. For all other disputes, Vienna is agreed as the place of jurisdiction to the extent permitted by law. Should individual provisions of these Terms be invalid or unenforceable, the validity of the remaining provisions is unaffected.
